International family law

A growing number of families are multicultural. Others are required to move internationally, sometimes to several successive countries, where they send their children to school, acquire property and forge ties. Family disputes that may arise in this context are all the more distressing for those who experience them, due to the feeling of legal insecurity they provoke.

SPECIFIC RULES

Family law issues thus contain an international dimension that requires the application of specific rules, in order to determine which judge will be internationally competent to hear the dispute, which law(s) he or she will have to apply to resolve the legal issues that arise, and how it can be ensured that a court ruling or agreement can be enforced throughout the world, and in particular in States where you have family and property interests.

It is also sometimes a question of acting quickly, to avoid, for example, the illicit removal of your child, the dilapidation of your assets or the seizure of a legal order unfavorable to your interests.

International Legal Assistance for Families

Our training and skills in international private law, and our fluency in English, enable us to assist you in resolving your disputes, even when this means taking action in a foreign country. If this is the case, our worldwide network will be able to recommend the services of competent and reliable foreign lawyers who will, in turn, be able to defend your interests.

We can help you with:

  • Applications to transfer the residence of children when moving between France and another country;

  • Divorces of French nationals living abroad, provided that the French judge has jurisdiction to hear the dispute, which will depend on your place of residence and that of your spouse, as well as the latter's nationality;

  • Divorces of foreign nationals who live in France;

  • The liquidation of matrimonial property regimes or successions when there is more than one asset to be divided, located in more than one country;

  • International child abduction, in the case of illegal abduction or non-return of your child;

  • Questions relating to parentage, particularly in the context of planned international adoptions;

  • Medically assisted procreation;

  • Modifications, mentions or transcriptions of civil status following the birth of your child, born abroad as a result of surrogacy.
